SUBJECT: Pending Litigation Involving the Americans with Disabilities Act

The Federal Transit Administration (FTA) is requesting current grantees within this Region for information on any pending litigation involving the Americans with Disabilities Act (ADA) to which your organization is a party. The U.S. Department of Transportation and the U.S. Department of Justice signed a Memorandum of Understanding last year to improve coordination of their work on ADA matters. http://www.fta.dot.gov/civilrights/ada/civil_rights_3898.html
As part of that effort -- as well as FTA’s own work on ADA matters - ensuring that FTA has complete information on ADA-related litigation involving all grantees. FTA recognizes that pursuant to the terms of the Master Agreement, agencies may have notified FTA of all ADA litigation involving your organization. Nevertheless, FTA would appreciate a complete list of ongoing ADA-related litigation, even if the list includes pending cases already mentioned to FTA. Thank you for your cooperation, and ask that you provide us with the list within 7 days.
