Section 106 Programmatic Agreement for Washington State

This bulletin is to notify grantees that the Federal Transit Administration (FTA) intends to draft a programmatic agreement (PA) under CFR 800.14(b) of the National Historic Preservation Act between FTA, the Washington State Department of Archaeology and Historic Preservation (DAHP), and, if they elect to participate, the Advisory Council on Historic Preservation (ACHP).
 
The intent of the proposed PA is to address FTA funded undertakings, which have minimal potential to affect Section 106 resources, programmatically. FTA and DAHP are in the beginning stages of identifying projects and activities that will be covered in the PA. Projects and activities that are determined to be included in the PA would not require review by DAHP so long as all the terms and conditions set forth by the PA are met. Implementation of the PA would assist in streamlining the Section 106 process for agreed upon FTA projects in Washington State. Details of the PA including projects and activities that will be included have not yet been determined.

In addition to this bulletin, FTA will contact tribes in Region 10 regarding the PA by letter. FTA invites interested Tribal Historic Preservation Offices to work individually with FTA to draft a PA addressing activities on their tribal land. 

As the PA is in its preliminary stages, FTA welcomes grantees to submit examples of projects and activities that they believe should be included in the PA.
