Q. Is NYCT a State per Circular 4220.1F? The definition of State that appears on page I-6 of C 4220.1F can be construed to include NYCT (as an "instrumentality"). However, Chapter II 2. (b) titled "Recipients and Subrecipients that are not States" (page II-2) seems to indicate that regional transportation authorities are not States. Can you please confirm that the New York City Transit Authority is not considered a State as defined in the Circular?
A. NYCT would not fall within the circular's definition of a "State" as defined by Circular 4220.1F. They are subject to the Circular's provisions applicable to "Recipients”, “Local Governments”, “Government Recipients”, and "Recipients that are not States”.
