Disclosure of Litigation by Offeror

Q. We recently procured an Engineering Services contract with a consultant who recently was involved in a large litigation. Is the Consultant required to disclose this information to us prior to selection or award?

A. Whether a potential contractor is obliged to disclose its involvement in prior litigation will depend on whether your solicitation clearly established such an affirmative requirement.
