Hire of passenger transport vehicles with driver. Non-scheduled passenger transport. Special-purpose road passenger-transport services. Hire of buses and coaches with driver. A Framework Agreement will be established to appoint suitable operators of passenger carrying vehicles for the provision of special transport services across Nottinghamshire. This will include the provision of vehicles of various seating capacities and configurations, together with drivers and passenger assistants, to convey a wide range of service users to locations in the County and exceptionally to out-of-county establishments. Service users will include vulnerable adults attending day-care facilities and children with a range of special needs. (Service providers already accepted onto the County Council's Framework Agreement for Special Transport Services do not need to re-apply).

The Framework Agreement will be used to secure the provision of the County Council's Special Transport Services, comprising of special needs transport for children and vulnerable adults. This will relate to approximately 100-150 contracts for the duration of the Agreement, let for periods of up to 5 years.

SECTION III: LEGAL, ECONOMIC, FINANCIAL AND TECHNICAL INFORMATION

III.1)CONDITIONS RELATING TO THE CONTRACT

III.1.1)Deposits and guarantees required

The Authority reserves the right to stipulate the provision of a performance bond (from a bank or insurance company approved by the Council) for the sum equal to 10 % of the estimated annual value of the contract awarded or a parental company guarantee. Please see tender documents for further information.

Tender pricing must be in pounds sterling (GBP) and payments under this contract will be in GBP.

Information and formalities necessary for evaluating if requirements are met: Participants will be required to complete all questions within the Form of Tender. Part 1 will be for information purposes and Part 2 will be evaluated, with all questions carrying an equal weighting and Service Providers who are not able to confirm a positive response to questions will NOT be eligible to join the Framework Agreement.

Information and formalities necessary for evaluating if requirements are met: Suppliers will be required to complete details of and confirm if they hold the relevant levels of Vehicle Insurance, Employer Liability Insurance, Public Liability Insurance and Medical Negligence/Malpractice Insurance within the Form of Tender.

Minimum level(s) of standards possibly required Minimum levels of insurance required are as follows:

Employers Liability Insurance: 10 000 000 GBP or greater, covering any liability for any one claim arising under the contract.

Public Liability Insurance: 5 000 000 GBP or greater, covering any liability for any one claim arising under the contract.

Vehicle Insurance: 5 000 000 GBP or greater, covering any liability for any one claim arising under the contract.

Precise information on deadline(s) for lodging appeals: The Authority will incorporate a minimum 10 calendar day standstill period at the point information on the award of contract is communicated to Tenderers. This period allows unsuccessful tenderers to seek further debriefing from the contracting authority before the contract is entered into. Applicants have two working days from the notification of the award decision to request additional debriefing and that information has to be provided a minimu of 3 working days before expiry of the standstill period. Such information should be required from the address stated in Section I.1.2 If an appeal regarding the award of a contract has not been successfully resolved, the Public Contracts Regulations 2006 (SI 2006 No.5) provide for aggrieved parties who have been harmed or are at risk of harm by a breach of the rules to take action in the High Court (England, Wales and Northern Ireland). Any such action must be brought promptly (generally within 3 months). Where a contract has not been entered into, the Court may order the setting aside of the award decision or order the Authority to amend any document and may award damages. If the contract has been entered into, the Court may only award damages.
