Q.  We recently awarded an Engineering Services contract to a consultant who recently was involved in a large litigation. Was the Consultant required to disclose this information to us prior to selection or award?

A. Whether the Consultant was required to disclose its involvement in prior litigation depends on whether your solicitation clearly established such an affirmative requirement. (Reviewed: August 28, 2009)
